These Terms of Use apply to this website (aliferemembered.au) and to our services. This website, A Life Remembered, is owned and operated by Vincent Press (ABN 57 878 525 617), a registered business name of James Phillip Vincent. In these terms, “we”, “us” and “our” refer to that business. By using this website or engaging our services, you agree to these terms.

Our services

We create personal legacy books through relaxed, recorded story-gathering conversations, which are transcribed and thoughtfully written into a finished book. The specific scope, inclusions and price for your book are confirmed with you before the story-gathering begins. Prices shown on this website are indicative until confirmed with you in writing.

Bookings, fees and payment

A deposit is required to confirm your booking and reserve your story-gathering sessions. The remaining balance is due before your completed book goes to print. We will confirm the fees, inclusions and schedule with you before any work begins.

Cancellations and changes

If you need to cancel or reschedule, please let us know as early as possible. If you cancel before your first story-gathering session, your deposit is refunded less our set-up costs. Once your sessions have begun, the deposit is non-refundable and you are charged only for the work completed up to the date you let us know — for example the sessions held and the writing done to that point. You are not charged for printing, or the remaining balance, if you cancel before your book goes to print. We may reschedule sessions where reasonably necessary and will work with you to find suitable times.

Your materials and the finished book

You may provide us with photographs, documents and information to include in your book. By providing them you confirm you are entitled to do so, and you grant us the permission we need to use them to write, produce and publish your book. You keep ownership of the photographs, documents and personal information you supply, and of your own life story.

We own the finished book — including the written text, layout and design, and the published edition, which we register with its own ISBN and publish. You receive the copies included in your package, and you and your family can order additional copies at any time through the print-on-demand link we provide.

Recordings of your conversations are used only to create your written book, and no audio recording is included with the finished book. We keep the recordings securely for six months after your book is delivered, and then delete them.

Any separate consent for recording your story-gathering sessions is agreed with you directly and is additional to these terms.

Using this website

Please use this website only for its intended purpose and as permitted by law. You must not misuse it — for example by attempting to disrupt or gain unauthorised access to it, distributing malicious software, or collecting data from it by automated means or for direct marketing.

Website content and intellectual property

We or our licensors own the copyright and other intellectual property rights in this website and its content. You may not copy, reproduce, distribute or commercially exploit any part of the website without our prior written permission, except as permitted by law (such as the right to quote).

Third-party links

This website may link to other websites we do not control. We are not responsible for their content, products, or privacy practices, and you use them at your own risk.

Disclaimers and liability

This website and its content are provided on an “as is” and “as available” basis and may contain inaccuracies or errors. Nothing on this website is professional, legal, financial or medical advice.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to those rights, and to the maximum extent permitted by law, our total liability arising out of or in connection with this website or our services is limited to re-supplying the relevant services or refunding the amount you have paid us for them.

Privacy

We handle your personal information in accordance with our Privacy Policy.

Events beyond our control

We are not liable for any delay or failure to perform caused by events beyond our reasonable control.

Changes to these terms

We may update these terms from time to time. The date at the top is the latest revision. Changes take effect once posted here, so please review them occasionally.

Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of Queensland. If any provision is found to be unenforceable, the remaining provisions continue to apply.
